In the state of Kansas it takes 60 days for an uncontested divorce. In the meantime I’ve heard that if the court finds out you are still having sex with your spouse they will automatically annul the divorce process. I was also wondering if it is adultery to have sex with another partner during this time. Please only answer if you know what you are talking about. (please no answering just to answer.)

What this indicates to me, is that the person who has the most to lose, should stay celibate till that divorce is final.

yes it is,definately.legally the person you call your "partner" isnt.i wouldnt tell the courts about him/her either or you will lose.cant you keep yourself until its over? i cant believe people these days.
It is probably a state by state issue and you should check with your attorney or the local courts. Here in CO you file legal separation first and after 6 months if no one contests the separation then it becomes a final divorce. No additional filings are needed. And the legal separation means you’re apart.
Yea….BUT….if the reason for divorce is because of adultery based on the other party (depending on the state) it has no bearing on the divorced process. In Michigan… for example…husband cheats…wife divorces him…during the divorce….wife has sex with someone…and husband tell judge…divorced was still granted due to infidelity on the husbands part…wife gets child support (if children are involved) wife gets alimony (if not working during marriage) wife was granted custody of kids (again if kids are involved because his character showed the courts a neg view) It’s a lot of "Ifs and But’s" but what I find similar in the question is, it was uncontested.
You are still legally married until you are legally divorced.

Adultery is engaging in sexual intercourse or sodomy with a person who is not married to the offender if:
The offender is married; or
The offender is not married and knows that the other person involved in the act is married.
Adultery is a class C misdemeanor

I am currently going through a divorce in Louisiana and I was told by my lawyer that we have to be separated and living apart for 1 full year without having sexual relations with one another, or someone else. However, if one of us does decide to have sexual relations with another partner and the other finds out and can prove it, this would be grounds for adultery and we could get the official divorce granted a lot sooner. I’m not sure what the consequences for that action would be; however, in my case, I am considering it, just so I can be divorced from him quickly!! (lol) Just joking! I hope this helps!
